Habeas corpus was used by Union officials to free unarmed African Americans from prisons, jails, and camps during the Civil War. In 1863, President Abraham Lincoln issued the Habeas Corpus Suspension Act, which allowed Union officials to use habeas corpus in order to arrest and detain Confederate supporters and sympathizers. Union officials also used habeas corpus to free African Americans, including former slaves and free blacks, who were being held in the Confederate states without legal justification. In some cases, these individuals were accused of a crime, but without a trial or any due process. Habeas corpus allowed Union officials to investigate these cases, as well as release innocent victims denied their civil liberties.
